This Artwork & Intellectual Property Policy explains how Albie’s Art handles customer-submitted artwork, logos, badges, patches, seals, emblems, reference images, custom designs, website content, product photos, design files, mockups, portfolio use, fan-inspired artwork, third-party intellectual property, and ownership of creative work.
By using https://www.albiesart.com, submitting artwork, requesting a quote, approving a design proof, placing an order, purchasing a product, or working with Albie’s Art on a custom project, you agree to this Artwork & Intellectual Property Policy, our Terms & Conditions, Privacy Policy, Custom Order Terms, Shipping Policy, Returns & Refunds Policy, and any written order-specific terms connected to your project.
1. Purpose of This Policy
Albie’s Art creates and sells custom challenge coins, collectible coins, tribute pieces, presentation products, creative collectibles, cosplay-related items, display pieces, and other artwork-based products.
Many projects involve artwork, logos, patches, badges, military-style elements, unit names, organization names, company names, fan-inspired themes, memorial details, personal images, customer-provided references, or original Albie’s Art designs.
This policy is intended to clarify:

2. Customer Responsibility for Submitted Materials
When you submit artwork, logos, badges, seals, patches, emblems, photographs, sketches, drawings, slogans, names, dates, text, symbols, characters, reference images, AI-generated images, or any other material to Albie’s Art, you are responsible for making sure you have the right to use those materials.
By submitting materials to Albie’s Art, you confirm that:

You own the submitted material, or

You have permission from the owner, or

You are authorized to request its use for your project, and

The material does not violate any copyright, trademark, privacy right, publicity right, contract, law, regulation, or third-party right.
Albie’s Art is not responsible for verifying ownership or legal clearance of materials submitted by customers.

If you are not sure whether you have permission to use something, you should obtain permission before submitting it.
4. Permission to Use Customer-Submitted Materials
By submitting materials to Albie’s Art, you grant Albie’s Art permission to use those materials as needed to review, quote, design, proof, revise, produce, manufacture, package, ship, display, photograph, and complete your project.
This permission includes the right to:

Review the submitted material

Store the material for project records

Use the material in mockups or proofs

Use the material in production files

Share the material with production partners, manufacturers, suppliers, or fulfillment providers when needed

Use the material to communicate with you about the project

Use the material to complete the ordered product
This permission does not mean Albie’s Art claims ownership of customer-owned materials.
5. Customer Warranty of Rights
By submitting materials, you represent and warrant that:

You have the legal right to submit the material

You have the legal right to request the project
-
You have permission to use any protected material included in the project
-
The submitted material does not infringe or violate another party’s rights
-
The finished product requested by you will not violate another party’s rights because of the material you provided
-
You are not asking Albie’s Art to knowingly create an unlawful, infringing, or unauthorized product
If this statement is not true, do not submit the material.
6. Third-Party Logos, Trademarks, & Brand Names
Customers sometimes request designs involving logos, brand names, team names, company marks, organization marks, entertainment properties, characters, slogans, or other third-party identifiers.
Unless specifically stated in writing, Albie’s Art is not affiliated with, endorsed by, sponsored by, licensed by, or approved by any third-party brand, company, organization, entertainment studio, trademark owner, rights holder, or government agency.
All third-party trademarks, names, logos, service marks, characters, brand identifiers, and copyrighted materials remain the property of their respective owners.
Customers are responsible for obtaining permission before requesting use of third-party material.
7. Military, Government, Agency, Public Safety, & Organizational Marks
Projects may involve military-style artwork, veteran themes, unit-inspired artwork, first responder designs, law enforcement designs, fire department designs, EMS designs, agency-style seals, badges, patches, or public service imagery.
Customers are responsible for confirming they are authorized to use any official or protected marks, including but not limited to:

Restricted symbols

Albie’s Art may decline or modify projects that appear to involve unauthorized use of protected, restricted, or official marks.
Unless specifically stated in writing, products created by Albie’s Art are not official government, military, agency, law enforcement, fire department, EMS, or public safety products.
8. Fan-Inspired, Tribute, Homage, & Unofficial Designs
Some products or custom requests may be inspired by fandom, pop culture, entertainment, comics, animation, movies, television, games, attractions, historical themes, public figures, or existing creative works.
Unless specifically stated in writing, fan-inspired, tribute, homage, parody-style, commemorative, or themed products are unofficial creative works and are not affiliated with, endorsed by, sponsored by, licensed by, or approved by any third-party rights holder.
Albie’s Art may decline, modify, remove, or cancel a project or product listing if there is a concern about copyright, trademark, licensing, publicity rights, or other legal risk.
Customers requesting fan-inspired work are responsible for obtaining any needed permissions.
9. Artwork From Other Artists
If you submit artwork created by another artist, designer, photographer, illustrator, AI artist, vendor, organization, manufacturer, or creative professional, you must have permission to use it for your project.
Albie’s Art may ask for proof of permission, but is not required to do so.
You may not submit another artist’s work and ask Albie’s Art to copy it without authorization.
Reference images may be used to understand style, mood, layout, or inspiration, but Albie’s Art may refuse to duplicate another artist’s work exactly.
10. AI-Generated Images & AI-Assisted Artwork
Customers may submit AI-generated or AI-assisted images as inspiration, reference, or concept material.
By submitting AI-generated or AI-assisted material, you confirm that your use of that material complies with the terms of the AI tool or service used to create it and that you have the right to submit and use it for the requested project.
Albie’s Art may use AI-generated images as reference, inspiration, or concept direction, but final custom artwork may be adjusted, redrawn, redesigned, simplified, stylized, or modified to work for production.
Albie’s Art does not guarantee that AI-generated images are free from third-party rights issues.
Customers are responsible for making sure AI-generated material does not infringe or imitate protected artwork, characters, logos, brands, or third-party rights.
11. Albie's Art Original Work
Unless otherwise agreed in writing, Albie’s Art owns or controls the original creative work it creates, including but not limited to:

Purchasing a product or custom order does not automatically transfer ownership of Albie’s Art intellectual property.
12. What the Customer Receives
Unless otherwise stated in writing, when you purchase a custom product from Albie’s Art, you receive the finished physical product described in the order, quote, invoice, or product listing.
For example, this may include:

Finished packaging selected for the order

Certificate of Authenticity if included

Final physical product purchased by the customer
The customer does not automatically receive:

Any transfer of files, ownership, exclusivity, or reproduction rights must be agreed in writing and may require additional fees.
13. License to Use Finished Custom Products
After full payment, the customer may use the finished physical products for the purpose stated or reasonably understood in the order.
This may include:

Unless otherwise agreed in writing, purchasing a custom physical product does not give the customer the right to reproduce, manufacture, copy, resell, license, distribute, or mass-produce the design outside the agreed order.
14. Commercial Resale Rights
If you want to commercially resell products using artwork or designs created by Albie’s Art, you must receive written approval from Albie’s Art.
Commercial resale rights may require:

Without written approval, custom designs created by Albie’s Art may not be reproduced or commercially resold outside the purchased order.
15. Exclusive Rights
Exclusive rights are not included unless specifically agreed in writing.
If a customer wants a design to be exclusive, private, unavailable to others, or not reused in any form, this must be discussed before work begins and confirmed in writing.
Exclusive rights may require additional fees.
Even when exclusivity is granted, Albie’s Art may still retain the right to use general techniques, styles, design knowledge, workflows, production methods, and non-confidential creative approaches in future work.
16. Source Files & Production Files
Albie’s Art does not provide source files, production files, mold files, manufacturer files, vector files, 3D files, editable files, layered files, or working files unless specifically agreed in writing.
If source files or production files are requested, Albie’s Art may approve or deny the request at its discretion.
If approved, additional fees may apply.
Some production files may not be available for release due to manufacturer restrictions, supplier restrictions, licensing issues, third-party tools, or proprietary process concerns.
17. Proofs, Mockups & Previews
Proofs, mockups, previews, renders, sketches, and design drafts are provided for review and approval.
Unless otherwise agreed in writing, these remain the property of Albie’s Art and may not be copied, posted, modified, reproduced, used with another vendor, sent to another manufacturer, or used to create competing products.
A proof is not permission to reproduce the design elsewhere.
18. Rejected Concepts & Unused Designs
Unused concepts, rejected designs, early sketches, alternative layouts, and unused mockups remain the property of Albie’s Art unless otherwise agreed in writing.
Albie’s Art may reuse, modify, adapt, or develop unused concepts for other projects, unless the concept contains confidential customer-owned material or written exclusivity terms apply.
19. Portfolio & Marketing Use
Unless otherwise agreed in writing before work begins, Albie’s Art may photograph, display, publish, describe, or share completed work and project images for business purposes.
This may include:

Advertising

Printed promotional materials

Behind-the-scenes content

If you do not want your custom project shown publicly, you must request confidentiality in writing before work begins.
20. Confidential Projects
Customers may request that a project remain private or confidential.
Confidentiality requests must be made in writing before design work begins.
If Albie’s Art accepts a confidentiality request, we will make reasonable efforts not to publicly display the project.
Confidentiality does not prevent Albie’s Art from sharing necessary information with:

21. Product Photos & Website Images
Product photos, renders, mockups, lifestyle images, layout examples, and website images created by or for Albie’s Art are owned by Albie’s Art unless otherwise stated.
You may not copy, download, reproduce, modify, repost, sell, use in ads, use on competing listings, or use Albie’s Art images without written permission.
Customers may share photos of products they purchased for personal, non-commercial purposes, such as showing their order on social media, provided the use is lawful and not misleading.
22. Customer Photos & Testimonials
If you send Albie’s Art photos, videos, reviews, testimonials, unboxing images, display images, or product-in-use images, you grant Albie’s Art permission to use them for business, website, portfolio, social media, marketing, and promotional purposes unless you clearly state otherwise in writing.
Albie’s Art will not intentionally publish private contact information such as your phone number, billing address, shipping address, or email address as part of a testimonial or customer photo.

All content on https://www.albiesart.com is owned by Albie’s Art or used with permission unless otherwise stated.

26. Right to Refuse or Remove Projects
Albie’s Art may refuse, pause, modify, remove, or cancel a project or product listing if we believe it may involve:

Unauthorized use of a character or entertainment property

Albie’s Art may identify potential concerns with submitted materials, but we do not provide legal advice.
Customers are responsible for consulting an attorney if they have questions about copyright, trademark, licensing, fair use, parody, right of publicity, government marks, military insignia, fan art, or commercial use.
Albie’s Art’s acceptance of a project does not mean the project is legally cleared or approved by any rights holder.
32. Relationship to Other Policies
This Artwork & Intellectual Property Policy works together with our other website policies.
If there is a conflict between this policy and a written signed agreement, the written signed agreement may control for that specific project.
If there is a conflict between this policy and general product descriptions, this policy controls unless otherwise stated in writing.
33. Changes to This Policy
Albie’s Art may update this Artwork & Intellectual Property Policy from time to time.
The updated Effective Date will be posted at the top of this page.
Changes apply to future quote requests, orders, submissions, and website use unless otherwise required by law.
